Privacy policy.

Background

Folly is a sole trader who does Brand & Content Marketing Strategy Consultancy, registered at Lytchett House, 13 Freeland Park, Wareham Road, Poole, Dorset, BH16 6FA

The purposes of this privacy notice/policy are to inform you about the data and information that we collect, your rights, and how we protect and use your data.

Folly will always keep any information that we collect private and in accordance with the UK Data Protection Act 2018 including its applied GDPR provisions (DPA 2018).

What personal information will be collected?

At Folly, I don’t take payments online or run any targeted advertising campaigns - so the data that’s collected is very basic and generally anonymous.

Across all tools, the data collected is:

  • Name

  • Company name

  • Email address

The ways I collect data are:

Google Analytics

This is anonymous data and is using ‘cookies’ - little bits of tracking code that follow what you do online so that I can see how many people have clicked onto my website and what they’ve done online.

That sounds a little scary, but really it’s all totally anonymous - I don’t know who has done what - just that 13 people have read a blog, and then gone on to contact me.

It’s really useful stuff that helps me make marketing decisions. But I don’t use it for anything other than that.

You can also disable cookies. Here is a handy guide to let you know how to do that on Google Chrome (other browsers exist, and will have similar guides - if they use cookies at all).

Newsletter - Mailerlite

If you’ve been kind enough to subscribe to my newsletter, then I will have captured some personal data. Namely:

  • Name

  • Company name

  • Email address

This data is then stored securely in Mailerlite (the subscription form sends the data directly there, as it’s an embedded form). You can find out more about how your data is stored and protected at Mailerlite here.

It’s called a ‘Data Processing Agreement’ because that’s the correct term for its role in GDPR. I am the data controller, and Mailerlite is the data processor. You can read more about that kind of stuff on the ICO website.

Calendly

I use Calendly to book calls and meetings, and capture information for new leads. It helps me qualify leads and also means that we come to meetings with all of the basic information-gathering bits already done. Super handy.

In terms of data, I capture:

  • Name

  • Email address

  • Name of company

  • Inquiry details - including: budget, timescales, a brief description.

It will also ask you if you would like to subscribe to my newsletter. If you are so kind as to say yes, I will then manually add you to the subscriber list in Mailerlite. If you say no, I will use your email purely for the purpose of communicating with you about the opportunity (and potentially, eventually, the job) - but I will never sign you up to the newsletter as you’ve said no.

Your email will be stored in my CRM for tracking my sales pipeline. There is more information about my CRM coming right up.

Zoho Bigin

I use a CRM system called Zoho Bigin to track my sales pipeline and keep track of my contact details.

I never store any data in there that hasn’t been voluntarily given to be and contact regarding my marketing services agreed. I usually will gather data through: lead generation (you giving me your details through Calendly), networking (you giving me your email through business cards, verbally, or on a napkin), or if you’ve gotten in touch with me through my own email.

I cleanse my CRM every 12 months, and will only ever contact people on there about the topics that they’ve asked to be kept in touch about.

Changes to and retention of the data

You are able to make changes to your data by emailing me at emily@follycreative.co.uk, and should do so in the following circumstances: change of email address, change of contact preference.

Your data will be retained for 5 years. On expiration of that date your data will be deleted from my CRM and Mailerlite unless you opt in to stay on the system. This will be reviewed in 2027.

You can unsubscribe from my newsletter at any time through the unsubscribe button in my emails. Or you can email me to unsubscribe.

User’s rights including the right to object or withdrawal of consent

Your consent to usage of your data can be withdrawn at any time. To do this, you must unsubscribe through the button in my emails. Or you can email me to delete your data.

Here’s a legal bit:

  • Under UK data protection laws users have the following rights:

  • The right to be informed about the processing of personal information;

  • The right to have personal information corrected if it is inaccurate and to have incomplete personal information completed;

  • The right to object to processing of personal information;

  • The right to restrict processing of personal information;

  • The right to have personal information erased;

  • The right to request access to personal information and how it’s processed;

  • The right to move, copy or transfer personal information; and

  • Rights in relation to automated decision making which has a legal effect or otherwise significantly affects the user.

The above rights cannot be exercised in all circumstances and therefore not all requests will be approved. Any responses received will outline which rights apply (or don’t) and whether we will comply with the request or not and the reasons why.

Opting out of communications

You may have signed yourself up, but you are absolutely allowed to change your mind and want to opt-out of my marketing and non-essential communications. You can do this through emailing me at emily@follycreative.co.uk.

Right of complaint

I will always ensure that I do it all by the book - however, you have the right to complain to the Information Commissioner’s Office which enforces data protection laws: www.ico.org.uk.

Ideally, contact me first as the data controller as I will be able to ensure that any issues are resolved before you escalate it.

Changes to the notice/policy

This is my policy, and I may make changes at any time to reflect updates to the law or changes to where I collect or store your data.
